Supreme Court shuns Oshawa ship-jumper
The Supreme Court of Canada declined to hear the case of a Sri Lankan man who jumped ship in Oshawa and was later denied refugee status. Canada’s highest court announced its refusal on June 12. It didn’t, and doesn’t have to, give a reason for the decision. The case involved a man from Sri Lanka who came to Canada aboard a merchant ship. In November 2011, the vessel docked at the Port of Oshawa. The man deserted the ship within days of arriving at the port, “with the intention of seeking refugee protection in Canada,” states a summary from the Supreme Court. But because the man had abandoned ship, the Canada Border Services Agency (CBSA) said he was not allowed to enter Canada and a removal order was issued 12 days after he had arrived. Originally from Sri Lanka, the man had boarded the M/V Lake Ontario in Algeria and travelled to three port cities in the Mediterranean Sea before heading to Montreal and Oshawa. According to the appeals decision, the ship docked at the Port of Oshawa on November 27, 2011. A few days later, the ship’s agent wrote to Canadian customs indicating two crewmembers had deserted the ship. One of those said to have deserted was the man from Sri Lanka. The M/V Lake Ontario left Oshawa on December 4, 2011 and headed for the Port of Duluth in Minnesota. http://www.oshawaexpress.ca/viewposting.php?view=6682
