Mayor of Pagudpud suspended due to Nam Yang 8 affair
The Ilocos Norte Governor on June 8, 2011, approved the suspension of Pagudpud Mayor after the mayor defied an order to remove the wreck of the "Nam Yang 8" from the town’s shores. She had signed the provincial board’s recommendation imposing a 60-day preventive suspension on her, which would take effect immediately. She is also facing another court battle at the Regional Trial Court in Bangui town regarding the prohibition of Ao Yang Marine Co. Ltd., the owner of the "Nam Yang 8", from disposing of the vessel or entering the wreck. The prohibition will last until June 19. The mayer said she did not intend to defy any order for the wreck’s removal. But representatives of the vessel’s owner surreptitiously moved scrap metal from the vessel out of Pagudpud and sold these to junkyards. More than half of the vessel has been taken out of Pagudpud, so she was only blocking the transfer of scrap metal out of Pagudpud and not the removal of the wreck from the shores. She said the vessel owner has not taken any action to assure the town that its claims, about P15 million in damaged marine resources, are paid. The vessel’s supposed insurance coverage has been raised as a guarantee.
Juristical standoff regarding removal of Nam Yang 8
The standoff over the removal of the "Nam Yang 8" from the shores of Pagudpud, Ilocos Norte, has reached the courts. The vessel owner, Aoyang Marine Co., has been trying to remove the wreck, while mayor Matilde Sales sought court help to stop Aoyang from removing the vessel for fear that the town’s claim for damages will vanish with the vessel. The regional trial court in Bangui town granted Sales’ petition for a 20-day temporary restraining order (TRO) on May 31, 2011. A hearing was set on June 9. Ilocos Norte Gov. Imee Marcos has repeatedly called on Sales to allow the owner to remove the vessel along with scrap metal that had been salvaged. The threat of new oil seepage continues to hang over Pagudpud’s waters as long as the vessel is there. On June 6, the provincial board recommended the 60-day preventive suspension of Sales, effective immediately, for defying calls for the removal of the vessel. The two-month period to salvage the vessel ended on May 16. Since last year, two salvors, Harbor Star and Pen Con Corp., have come and gone. The vessel owner should hire another salvor because the second salvor, Pen Con, had caused two cases of oil leaks in March, and earlier in June. At least 50 percent of the vessel’s metal has been removed. Mayor Sales said the salvaged materials were the town’s remaining guarantee that its claims for damages will be paid. Resort owners are likely to file separate claims for damages.

Salvors of PEn Con conduct clean up of fresh oil traces that spilt from the pipes of the "Nam Yang 8" on Mar 31 during demolition works. The salvor was told to use oil spill dispersants and sprayer to remove all the oil that seeped from the wreck when salvaging was in progress. Pen Con started dismantling the vessel on Mar 17 and was told to completely remove it from Pagudpud shores within 60 days. But on Mar 31, around five tons of bunker oil seeped from the vessel’s pipe system causing oil traces to spread one kilometer from where the vessel sits. Two tons been recovered since, while oil clean up continues until all traces have been removed. An oil spill boom will be prepositioned once salvaging resumes.
