Alang ship gets deathbed reprieve
Sri Lanka's telecom major failed to get a compensation from a ship that had damaged its submarine cable connecting SL with Maldives on its final voyage to Alang. The Gujarat high court refused to direct the vessel owner to pay damages, because by this time, the ship has been beached at its graveyard for dismantling. The high court ruled that since it has been beached and cleared for dismantling, it cannot be considered a vessel any longer. Because the ship is no longer in the territorial waters of India, but is beached on an intervener's plot, it becomes goods. Hence the court's admiralty jurisdiction cannot be invoked. On its last voyage to Alang, a container carrier M V ACX HIBISCUS with Panamanian flag was anchored near Colombo in April. The ship was anchored in dangerous vicinity of the submarine cables owned by Sri Lanka Telecom PLC. http://timesofindia.indiatimes.com/city/ahmedabad/Alang-ship-gets-deathbed-reprieve/articleshow/16884761.cms
