Master fined by district court after drunken driving and bridge allision
The master of the 'Lemsterland', which had allided with a bridge on the Northern Elbe in Hamburg during a storm on Jan 30, 2022, while he had an alcohol level of 1.5 per thousand, has been sentenced by the district court on May 8, 2023, to a fine of 60 daily rates of 45 Euros each, i.e. a total of 2700 Euros. The defendant accepted the verdict. He had previously received a penalty order for 60 daily rates of 100 Euros each. He had filed an objection to the amount of the daily rate. The 45 year old man had cast off during the storm "Nadia" and sailed upstream. After a few minutes, the ship slammed into the bridge. The captain and his deckhand remained uninjured, but there is damage of almost 780,000 euros. According to the public prosecutor, damage of 460,000 euros was caused on the bridge that connects Hafencity with the Veddel district. The impact deformed a cross member and damaged a longitudinal member connection. A wind bracing, i.e. part of the striking steel girder construction on the bridge, was completely destroyed. In addition, a damaged gas line had to be sealed off. The bridge remained closed to traffic for four months for repairs. The closure also delayed a renovation of the motorway 255, because the damaged bridge was not available as an alternative route. The damage to the ship was 297,000 Euros. The salvage costs amounted to almost 22,000 Euros. It was unclear whether civil claims will be asserted against the Dutch captain. The district court did not have to decide on this in the criminal proceedings and did not need to discuss how the accident happened because the accused accepted the penalty order with regard to the number of daily rates. The captain lost his job as a result of the accident. Whether he still owns his patent remained unclear. He regretted his alcohol trip and has been doing drug and alcohol withdrawal therapy for the past year. The judge accepted his remorse. Because the captain is currently only living on unemployment benefits and paying maintenance for a child, the daily rate was reduced. The defendant could not say whether he also had to pay for the damage.
Oil spill in Glückstadt
In the afternoon of Sep 8, 2019, around 3 p.m. the "Lemsterland" caused an oil spill in the outer port of Glückstadt. The water police was alerted by witnesses and remarked and oily substance flowing from the berthed vessel. It was presumably hyraulic fuel. There was no crew on board at that time. The fire brigade was alerted and contained the spill. The police launched an investigation.
Fire in engine room soon extinguished
On Apr 2, 2013, a fire broke out in the engine room of the "Lemsterland" in Farmsum. At 3.20 a.m. the fire Brigade of Delfzijl was called to the berth in the Industrial Park in Farmsum. The fire was tackled with foam. After the fire, thermal cameras were used to find remaining hot spots.
