Tug remains seized in IJmuiden

In a dispute over unpaid charter for two tugs, Kotug has seized another tug owned by Fako, the renting party, the 'Fako Namme Menyoli 2', 377 gt (IMO: 9376218). Kotug leased the tug 'RT Margot' to Fako in Cameroon from January 2016 to July 2018, and also the 'RT Zoë' from February 2017 to July 2018. As of August 2018, the two tugs were leased to a sister company of Fako. A year later, the companies concluded a so-called 'settlement agreement'. In it, Fako acknowledged that 4,6 million Euros were still owed for the charter of the two ships. A payment arrangement was also agreed. Three years later, Kotug tried through various arbitration procedures to recover the arrears of charter, plus other costs, from Fako. In total, Kotug demanded from Fako and the sister company Cape Limboh more than nine million Euros. When Fako became the owner of the 'Falo Namme Menyoli 2', Kotug seized the ship, which was moored in IJmuiden on Jan 11, for more than 3,1 million Euros. Fako tried to have this seizure levied through court proceedings. The seizure was allegedly wrongfully placed on this ship and, moreover, Fako stated that there was nothing more to claim. With the seizure, Kotug wanted to achieve a payment of one million Euros (or another reasonable amount in the eyes of the judge) as an advance on what the arbitrators of the London Maritime Arbitrators Association will award. The court has ruled that the seizure is allowed. The defense that the claim would not be recoverable from the 'Fako Namme Menyoli II' was also dismissed by the court. Fako has not been able to substantiate his claims. The court has also seen no evidence for the defense that the claimed amount of 4.6 million Euros is much too high. The seizure of the tug may therefore remain in force. However, Kotug does not receive the desired advance of one million Euros. The 'Fako Namme Menyoli II' is worth much more than one million Euros. Also with a view to depreciation and other creditors, that value offers Kotug room to await the verdict of the arbitrators.

Former Bugsier tug en route to Cameroon

The former Bugsier tug "Bugsier 6", having been renamed 'Fako Namme Menyoli 2' under the St. Vincent flag set course for Cameroon in the afternoon of Jan 9, 2023. The transfer will be carried out by a crew from the Dutch company Redwise Maritime Services who will need around four weeks for the approximately 5,000 nautical miles from Bremerhaven to Loméunder good conditions. The Fairplay Towage in Hamburg, parted with this and the identically constructedsister ship "Bugsier 4" at the end of 2022. The 'Bugsier 4' was renamed "Fako Namme Menyoli 1", but remained in Bremerhaven for a few more days, as necessary repair work still had to be carried out here.
